In many legal jurisdictions related to English common law, affray is a public order offence consisting of the fighting of two or more persons in a public place to the terror (in French: à l'effroi) of ordinary people (the lieges). Depending on their actions, and the laws of the prevailing jurisdiction, those engaged in an affray may also render themselves liable to prosecution for assault, unlawful assembly, or riot; in that event it is for one of these offences that they are usually charged. England and WalesIn current English Law, affray forms part of the Public Order Act 1986 under section 3. The act states:
A person suspected of affray is subject to arrest, can be tried either way, and faces three years imprisonment and/or a fine on indictment; six months imprisonment and/or a fine summarily. Asked by terrie b - Tue Dec 23 21:54:28 2008 - - 9 Answers - 0 Comments A. you dont have to hurt anybody for it to be an affray. otherwise it would have been an assault charge. he has good mitigation (ie. explanation for doing what he did) but provocation is NOT a defence. i advise that if matter goes to court he should plead guilty at first opportunity as he will get maximum credit, ie a 3rd discount of his sentence. dont worry he wont be at risk of prison, at best a conditional discharge which means he wont be punished there and then but should he commit another offence in next 12months he will sentenced much harsher OR at worst a community penalty, ie unpaid work and maybe an anger management programme. i am sure the magistrates will be sympathetic towards him and i am sure they will be lenient!! Q. I live in Wales and have been apparently 'charged' with affray in the isle of man. I have heard if I don't go back there that they cannot enforce it here as they work under a different jurisdiction. Is this true? Do local police work with the Isle of Man police? Drunken night with no one hurt surely cannot result in a record over here?what wil happen if i dont attend court ?
