I've been sponsoring my husband through the immigration process for years. I recommend that you wait for the 10 years for him to come back. He can then apply for a Fiance Visa to come into the states to marry you. After you're married he can change his status and get a conditional green card. Once you're married for 2 years you can get the condition removed and he has a green card. Three years from when he gets the conditional green card he can apply for citizenship. It's a long process, and he's already at a disadvantage because of being caught. Sorry to tell you but that is being in serious trouble as far as US CIS is concerned. I think this is ridiculous and the entire handling of it really makes you wonder whose welfare they are trying to protect.
