The Visa Waiver Program (VWP) is a program of the United States Government which allows citizens of specific countries to travel to the United States for tourism or business for up to 90 days without having to obtain a visa. The program applies to the 50 U.S. states as well as the U.S. territories of Puerto Rico and the Virgin Islands in the Caribbean, with limited application to other U.S. territories. All countries selected by the U.S. government to be in the program are high-income economies with a high Human Development Index and are regarded as developed countries.

has anyone faced deportation on the visa waiver program and been given a custody bond or voluntary departure?
Q. I dont see in the visa waiver program where you waive your rights to be released from detention. Its another proceeding than deportation. and where does it say mandatory detention for overstays on visa waiver. All i see is waived rights to fight deportation or admissability at the port of entery!!

A. The visa waiver is exactly what it says it is: a way for the citizens of certain countries to enter the US for up to 90 days for business or tourism without having to apply for a visa. If you overstay or attempt to adjust status, then you are subject to all the rest of US immigration laws, part of which provide for the detention and deportation of people who forget to go home.

A. It's possible, but considering this in your intention before you get on the plane, it's contrary to the purpose of VWP and they would certainly turn you around if they think this is what you're up to. Plus, you could be denied the ability to adjust if they have serious reason to believe this was your intent. The probability for that happening may not be all that high, but it is possible.
